Fighting for the Constitutional Rights of all American Citizens.

The purpose of RSOL is to end the punitive, public "sex offender" registry, residency restrictions, and civil commitment laws which endanger our society and stigmatize, shame, and unnecessarily ruin the lives of registered children, adults, and family members. We hope to raise critical awareness about legal and social policy in the United States about sex offenders. We believe these policies should change and that thoughtful people will agree when they know the facts. Read our official statement, Reform Sex Offender Laws Now!, which has been signed by academics, professionals, and activists. We are seeking your signature and support for our message, too.

Reynolds v. US - an Analysis

Jan 30, 2012

Analysis by RSOL Legal Team

There is some confusion regarding the recent decision of the United States Supreme Court dealing with retroactivity of the Adam Walsh Act (AWA). There were three issues before the Court, but none involved the constitutionality of sex offender registration itself.   ...Reynolds was indicted by a federal grand jury for violating the AWA. The Indictment alleged that Reynolds had engaged in “interstate commerce” when he moved from Missouri to Pennsylvania without keeping his registration current in either jurisdiction. Reynolds filed a Motion to Dismiss the government’s Indictment, arguing that the “Interim Rule” was invalid because it violated both the Constitution’s “non-delegation” doctrine and the Administrative Procedure Act (APA). Reynolds did not challenge the constitutionality of registration itself.
